The Russian Government has introduced a special procedure for amending certain public contracts in the fields of construction, design and engineering surveys.
On 24 August 2026, Government Resolution No. 1065 was adopted pursuant to Part 65.1 of Article 112 of Federal Law No. 44-FZ.
The new procedure does not apply to all government contracts.
When can a contract be amended?
All of the following conditions must be met:
- the contract was concluded before 1 January 2027 to meet federal government needs;
- the contracting authority is the Unified Customer in the Construction Sector (PPK “Ediny Zakazchik v sfere stroitelstva”);
- circumstances beyond the parties’ control have arisen during contract performance, making it impossible to perform the contract under its original terms;
- the contracting authority and contractor have agreed on the amendments.
A simple increase in costs or greater complexity of the works is not sufficient.
It is necessary to demonstrate why the contract cannot be performed under its original terms.
What can be changed?
- the contract completion date;
- the scope and types of works, specifications and types of equipment specified in the design documentation;
- construction resources — these may be replaced with equivalent alternatives, including with corresponding amendments to the design documentation;
- individual project stages, including their names, scope, types of work and price;
- advance payment terms — an advance payment may be introduced or amended within the maximum amount established for recipients of federal budget funds;
- the procedure for acceptance and payment of individual stages and work results;
- the contract price may be increased without changing the scope or types of work;
- treasury support arrangements, where payments under the contract or advance payments are subject to such support.
The Resolution covers engineering surveys, design, construction, reconstruction, technical re-equipment, major repairs, demolition, landscaping and architectural supervision.
It also covers works for the preservation of cultural heritage sites where the works affect their reliability and safety characteristics.
It is worth noting that engineering surveys are expressly identified as an independent subject matter of a contract.
Before signing an amendment agreement, the parties must:
- document the circumstances that have arisen;
- substantiate why the original contract terms cannot be fulfilled;
- calculate the revised deadlines, scopes of work, stages and contract price;
- determine whether the design documentation will need to be amended and whether a repeat expert review will be required;
- check the performance security and the availability of the necessary budget allocations.
The Resolution does not establish a specific percentage limit for an increase in the contract price or extension of the completion period. However, any amendments must be technically and financially justified, and the resulting ob
